1. Acceptance of Terms

By accessing or using the Canadian Prenup website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Canadian Prenup. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

The information and documents provided through our Services are for informational purposes only and should not be construed as legal advice. We strongly recommend that each party consult with independent legal counsel before signing any prenuptial agreement.

2. Description of Services

Canadian Prenup provides an online platform for creating prenuptial agreement documents. Our Services include:

  • Interactive questionnaires to gather information for your agreement
  • Generation of customized prenuptial agreement documents
  • Province-specific document formatting to meet local requirements
  • Customer support via email
  • Secure document storage and delivery

3. User Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be a resident of Canada or be entering into a marriage that will be governed by Canadian law
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and complete information

4. Account Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Fees and Payment

Our Services are provided for the fees displayed on our Pricing page. By purchasing our Services:

  • You agree to pay all fees and applicable taxes
  • Payment is due at the time of purchase
  • All fees are in Canadian Dollars (CAD) unless otherwise stated
  • We accept Visa, MasterCard, American Express, and Interac e-Transfer

Refund Policy: If we are unable to complete your prenuptial agreement for any reason, you will receive a full refund. For other refund requests, please contact us within 30 days of purchase. Refunds are provided at our discretion and may be subject to a processing fee.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Canadian Prenup or its licensors and is protected by Canadian and international copyright laws.

Upon payment, you receive a limited, non-exclusive license to use the prenuptial agreement documents generated for your personal use only. You may not:

  • Resell, redistribute, or commercially exploit our documents
  • Remove any copyright or proprietary notices
  • Use our trademarks without written permission

7. User Responsibilities

When using our Services, you agree to:

  • Provide truthful and accurate information in all questionnaires
  • Not use the Services for any unlawful purpose
  • Not attempt to interfere with or disrupt our Services
  • Not access accounts or data belonging to others
  • Not transmit viruses, malware, or harmful code
  • Comply with all applicable laws and regulations

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM:

  • Any warranty that our Services will be uninterrupted or error-free
  • Any warranty regarding the legal enforceability of documents created using our Services
  • Any warranty that our documents are suitable for your specific situation
  • Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANADIAN PRENUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Legal fees or costs arising from disputes related to your prenuptial agreement
  • Any damages resulting from the enforceability or interpretation of your agreement

Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid for our Services.

10. Indemnification

You agree to indemnify, defend, and hold harmless Canadian Prenup, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any dispute between you and your partner regarding the prenuptial agreement

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or our Services shall be resolved exclusively in the courts of Ontario, Canada, and you consent to the personal jurisdiction of such courts.

12. Dispute Resolution

Before initiating any legal action, you agree to first contact us to attempt to resolve any dispute informally. If we cannot resolve the dispute within 30 days, either party may proceed with formal dispute resolution.

13. Termination

We reserve the right to suspend or terminate your access to our Services at any time, without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users or our business
  • Is fraudulent or illegal

Upon termination, your right to use our Services will immediately cease.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Canadian Prenup regarding the use of our Services.
